Los derechos de los gobernados en el debate en torno al orden jurídico en la filosofía de Michel Foucault

Abstract

En este artículo me propongo analizar el problema del «derecho de los gobernados en Foucault» a partir de algunos artículos del dosier «Michel Foucault y el derecho» de la revista Dorsal, n.° 7. A partir de los principales problemas y argumentos presentados en tales artículos procuraré organizar los ejes centrales que articulan el debate actual en torno a la cuestión del derecho en la obra de Michel Foucault. En un segundo momento, a partir de dos conceptos expondré una cuestión insuficientemente problematizada en dicho dosier. A saber, los conceptos de «derecho del pueblo» y «deber de los gobernantes» y el problema del alcance de los derechos de los gobernados así como las condiciones de su ejercicio y las garantías que implica.

In this paper I intend to analyze the problem of the «Right of the governed» in Foucault, taking some articles of the dossier «Michel Foucault and the Law» publish by Dorsal in 2019. From the main problems and arguments presented in such articles, I will try to organize the central axes that articulate the current debate around the question of law and the «Right of the governed» in Michel Foucault’s work. Then, based on two concepts, I will expose an issue insufficiently analyzed in that dossier. Namely, the concept are «Right of the People» and «Duty of the rulers». The problem is the scope of the «Rights of the governed» as well as the conditions of their exercise and the guarantees that it implies
