Custodiar lo etéreo: Avances y desafíos en la protección jurídica del patrimonio inmaterial en Argentina

Abstract

Desde la segunda mitad del S. XX se produjo una progresiva ampliación en los bienes incluidos en el sintagma ´patrimonio cultural´ incluyendo aquellos elementos inmateriales como costumbres o testimonios significativos de una cultura. La Convención para la Salvaguarda del Patrimonio Cultural Inmaterial (UNESCO 2003) define los ámbitos de las manifestaciones inmateriales y establece el inventario como herramienta jurídica esencial de tutela. En Argentina, el inventario y la declaratoria han sido utilizados en el ámbito del patrimonio histórico-artístico desde la década de 1940. A partir del análisis de un conjunto de normas, jurisprudencia, y los relevamientos de patrimonio inmaterial realizados a nivel provincial y nacional es posible sistematizar el estado actual del régimen legal del patrimonio inmaterial en este país. Este trabajo procura consignar el estatuto jurídico del patrimonio inmaterial en Argentina a partir de las huellas que pueden rastrearse en la legislación y jurisprudencia de los últimos años.
