Intersecciones entre la propiedad privada y el derecho al patrimonio cultural. Dos casos de estudio en Argentina

Abstract

Este trabajo tiene como objetivo analizar los dispositivos jurídico-administrativos empleados ante conflictos entre la propiedad privada y el derecho al patrimonio cultural en dos inmuebles que han sido inscriptos en la Lista Representativa del Patrimonio Mundial (UNESCO): la Estancia Santa Catalina, del sitio Manzana y Estancias Jesuíticas de Córdoba y la Cueva de las Manos, Río Pinturas en la Provincia de Santa Cruz, Argentina. La investigación se limita históricamente a períodos en los cuales los conflictos fueron manifiestos. La metodología utilizada es cualitativa, a partir del análisis documental de archivos y noticias periodísticas, complementado con entrevistas a informantes clave.

This paper is aims to analyse the legal and administrative arrangements used to the conflicts between private property and the right to cultural heritage in two buildings that have been inscribed on the Representative List of World Heritage (Unesco): the Estancia Santa Catalina, from the Jesuit Block and Estancias of Córdo-ba and the Cueva de las Manos, Río Pinturas, in the Santa Cruz province, Argentina. The research is historically limited to periods in which conflicts were manifest. To develop the research documentary analysis has been used, based on the archives and journalistic news; and this was complemented by interviews with key informants.
