Agua, Estado y desarrollo agrícola: Análisis socio-jurídico de la disputa por el río Atuel (1941-1987)

Abstract

Este artículo aborda en profundidad la etapa específica del conflicto entre las provincias de Mendoza y La Pampa por el uso del río Atuel. El trabajo combina el enfoque conceptual de los estudios sociales del Estado y el agua con la Sociología del derecho y desde allí se analizan documentos jurídicos del litigio y otros documentos oficiales del período estudiado. Dicho análisis reconstruye la narrativa principal desde donde las partes proyectan el objeto jurídico. Asimismo, atiende de manera especial algunas categorías hídricas (cuenca, río, hectáreas irrigadas) que se utilizan para sostener y consolidar el eje agua-desarrollo como núcleo de la disputa. Se concluye que el Estado, durante la etapa prejudicial y después la justicia, ratifica un paradigma del desarrollo agrícola basado en el uso del agua. Con ello se sella la continuidad del conflicto durante las próximas décadas al tiempo que permanecen sin modificaciones las condiciones de acceso al agua de los pobladores afectados por su ausencia.

This article deals in depth with the specific stage of the conflict between the provinces of Mendoza and La Pampa over the use of the Atuel River. The work combines the conceptual approach of the social studies of the State and water with the Sociology of Law and from there legal documents of the litigation and other official documents of the period studied are analyzed. Said analysis reconstructs the main narrative from where the parties project the legal object. Likewise, it pays special attention to some water categories (basin, river, irrigated hectares) that are used to sustain and consolidate the water-development axis as the core of the dispute. It is concluded that the State, during the pre-judicial stage and after the justice, ratifies a paradigm of agricultural development based on the use of water. This seals the continuity of the conflict for the next decades while the conditions of access to water for the inhabitants affected by its absence remain unchanged.
