El concepto de "Constitución" en el Río de la Plata (1750-1850)

Abstract

Este artículo estudia los cambios y permanencias en el significado del concepto de constitución en el Río en un arco temporal de importantes cambios políticos. En sus particulares modulaciones semánticas, el concepto da cuenta del conflictivo proceso de revolución, guerras de independencia y disputas entorno al ejercicio y a la definición de la soberanía entre los "pueblos" que emergieron de la crisis de 1808. En efecto, el Río de la Plata no participa de la experiencia constitucional de Cádiz , e inicia tempranamente un período constitucional marcado por la redacción de reglamentos y estatutos provisorios, y de proyectos de constitución para la regulación de un Estado independiente, que se vio no obstante frustrado durante la primera mitad del siglo XIX. En este sentido, el concepto de constitución descubre las diversas alternativas de recomposición del cuerpo político hispano y revela algunas de las claves sustanciales para comprender las razones que hicieron fracasar los proyectos de organización nacional hasta 1852. Por último, este estudio muestra la importancia de la resemantización del concepto en la elaboración de una nueva argumentación sobre el diseño constitucional que acompañó a la creación del Estado-nación argentino.

This article studies changes and continuities in the meaning of the concept ‘constitución’ in the Río de la Plata along a period of important political transformations. In its particular semantic modulations, the concept shows the conflictive process of revolution, independence war and disputes around the exercise of power and the definition of sovereignty among the “pueblos” emerged from the crisis of the Spanish Monarchy of 1808. The Rio de la Plata did not participate in the constitutional experience of Cádiz and it early began a constitutional period which was marked by the writing of rules of regulation, provisory statutes and constitution projects for the regulation of an independent State, which nevertheless failed during the first half of the 19th century. Thus, the concept of constitution shows the diverse alternatives of recomposition of the Hispanic political body –which were not strange to the Rio de la Plata– and it explains some of the substantial keys to understand the reasons that led to the failure of the projects of national organization until 1850. Finally, this study shows the importance of the resemantization of the concept in the making of a new argumentation on constitutional design that went along with the creation of the Argentinean national State.
