Adopción y ¿homo-parentalidad u homo-fobia?: Cuando el principio de igualdad manda

Abstract

El presente artículo aborda el tema de la adopción por parejas del mismo sexo. La Ley 26.618, sancionada en julio de 2010 por el Parlamento argentino, que reconoce y extiende la institución del matrimonio a todas las parejas, con independencia de su orientación sexual, coloca a este país a la vanguardia de los Estados europeos que adoptan esta postura legislativa por aplicación del principio de igualdad. Dentro de este contexto, la cuestión más debatida y resistida es la adopción. ¿Sortea el “test de constitucionalidad” una normativa que limite o circunscriba la adopción a las parejas de diverso sexo? La respuesta negativa se impone, brindándose en este trabajo las diversas razones jurídicas y no jurídicas para arribar a esta aseveración.

This essay deals with a topic as current as com-plex: the adoption by same-sex couples. The law 26.618 enacted in July 2010 by argentine parliament recognizes and extends the insti-tution of marriage to all couples regardless of sexual orientation, place this country at the forefront of European states that adopt this le-gislative approach by applying the principle of equality. Within this concept, the most debated and resisted issue is the adoption. If the law limits or circumscribes the adoption to couples of the opposite sex is it coherent with the Hu-man Rights? The negative response imposes in this work by providing diverse legal and not le-gal reasons to arrive at this assertion.
