Giorgio Agamben irrumpió en el terreno de la teoría política trazando poderosas reflexiones en materia de biopolítica y, en particular, realizando una dura crítica al abandono del discurso jurídico político de la soberanía que había hecho Michel Foucault. En el presente artículo intento revelar que el rechazo de Michel Foucault al discurso jurídico político de la soberanía obedecía a razones históricas y metodológicas. En segundo lugar, me interesa mostrar que Agamben ha reinstaurado la noción de soberanía, pero sin atender a las prácticas jurídicas concretas. Finalmente, sugiero que las referencias a la soberanía y al derecho sin ningún tipo de atención a las prácticas pueden tener como causa el método basado en la utilización de paradigmas que Agamben propone. Giorgio Agamben burst into the realm of political theory drawing powerful reflections on biopolitics and, in particular, making a harsh criticism of the abandonment of the legal and political discourse of sovereignty developed by Michel Foucault. In the present piece of work I try to reveal that Michel Foucault’s rejection of political and legal discourse of sovereignty was due to historical and methodological reasons. Secondly, I would like to show that Agamben has restored the notion of sovereignty, but without attending to the specific legal practices. Finally, I suggest that the references to sovereignty and law without paying any attention to practices may be caused by the method based on the use of paradigms that Agamben proposes.
