Ética y telesalud: La autodeterminación informativa del paciente en la sociedad del conocimiento

Abstract

En la sociedad del conocimiento, el desarrollo de nuevas formas de almacenamiento de datos y registros, junto con la posibilidad técnica de cruzar dicha información proveniente de diversas bases de datos, ha llevado a la modificación de las mismas Constituciones Nacionales para garantizar –a nivel formal– la protección de datos personales y el derecho de autodeterminación informativa del ciudadano. Este derecho no se limita a proteger los datos sensibles, como lo es la información sanitaria del paciente, sino que se extiende a todos los datos personales asentados en archivos, registros o banco de datos, con el fin de defender derechos personalísimos. En el presente trabajo, me detendré a analizar el derecho a la autodeterminación informativa del paciente, proponiendo una justificación ético-política integral. Para ello, dividiré el trabajo en tres partes: una primera parte (I), histórica y crítica, donde mostraré el carácter obsoleto de la justificación patrimonialista de la privacidad (autonomía negativa); una segunda parte (II), constructiva, donde brindaré una justificación fuerte de la autodeterminación informativa basada en la equidad de acceso a bienes públicos (autonomía positiva); y una tercera parte (III), donde desarrollaré las condiciones de posibilidad de la citada autodeterminación informativa.

In the Knowledge Society, the development of new forms of storage of information and records, together with the technical possibility of crossing the above mentioned information from diverse databases, has led to the modification of the National Constitutions –at the formal level– to guarantee the protection of personal information and the informative self-determination right of the citizen. This right does not limit itself to protecting the sensitive information, as it is the health information of the patient, but it spreads to all the personal information mentioned in files, records or data base in order to protect personal rights. In the present paper I will analyze the right to the informative self-determination of the patient. An integral ethical and political justification of this right will be held. For it, I will divide the paper in the following parts: the first part (I) is a historical and critical analyses, where I will show the obsolescence of the privacy based on property (negative autonomy); the second part (II) is a new ethical and political analysis, where I will offer a strong justification of the informative self-determination based on the equal access to public goods (positive autonomy); in the third part (III) I will develop the conditions of possibilities of the above mentioned informative self-determination.
