Las estadísticas judiciales, los miedos y los mitos: Una pincelada a la justicia de menores en la Argentina

Abstract

El movimiento pro-reforma de la ley penal de menores en la Argentina, decreto-ley 22.278, hizo desfilar en el Congreso Nacional muchos proyectos de ley de signos distintos que propusieron ya fuera bajar la edad de imputabilidad penal, ya fuera la instauración de un régimen penal juvenil. En un contexto impregnado de pánico moral y exacerbación de la sensibilidad punitiva en el que el cambio legislativo deviene inminente, es necesario e impostergable promover un adecuado conocimiento del funcionamiento de la justicia de menores y su administración. Es el objetivo de esta presentación contribuir al localizar el debate y dimensionar en prospectiva los problemas que tendrá que afrontar la justicia ante la probable futura ley, que ya cuenta con media sanción.

A huge and diverse number of projects mirroring different political tendencies on the issue of Minor‟s Criminal Capacity have been presented at Congress in Argentina as the result of the movement in favor of changing the Minority Criminal Law (Decree-Law Nº 22.278).The proposals range from lowering the age of Criminal Capacity to the establishment of a special régime for young offenders. In a context of moral panic and an ever growing punishment sensitivity demanding a change in legislation, it is necessary and urgent to promote a proper knowledge of how minor‟s justice is administered. The aim of this paper is focusing on the debate, measuring and foreseeing the problems which the administration of justice will have to face in the future, once the probable law which has already been drawn, is fully enacted.
