Un concepto equívoco: Sobre la pluralidad de sentidos de la justicia en la obra política hobbesiana

Abstract

Este artículo parte de la percepción de que en la filosofía política hobbesiana existe una pluralidad de sentidos de la idea de justicia. Esta noción se aplica tanto a la acciones como a los hombres. La primera consiste en la conformidad de los actos con la ley civil. Las desavenencias se manifiestan en lo que hace a la segunda noción. Al respecto, presentamos dos visiones. Una es la de Leo Strauss, para quien puede asociarse a la justicia de las pasiones, y a una en particular: el miedo a una muerte violenta. La otra es la de F. C. Hood, para quien esta clase de justicia consiste en el reconocimiento de la obligación que la ley natural contendría, la cual es una obligación de conciencia. Este trabajo propone, a modo de hipótesis, que la justicia de los hombres adquiere dos sentidos que coexisten sin excluirse. Uno que la asocia a la justicia de las pasiones, aunque el miedo a la muerte no sea la única pasión justa. Y otro que consistiría en la voluntad de cumplir con la ley natural.

This paper begins with an impression: in Hobbes’ political philosophy it is possible to observe more than one idea of justice. This notion applies to actions and men. The first one rests in conformity of our actions with civil law. But there are disagreements with the interpretation of the second one. We show two different views. That of Leo Strauss, who says that justice of men is related with justice of passions. But he also says that the last is exclusively associated with fear of violent death. The other is F. C. Hood’s, who says that this kind of justice rests in recognition of the obligation that natural law implies, which is an obligation of conscience. This work puts forward the following hypothesis: that justice of men has two coexisting meanings. First, it consists in justice of passions, but fear of a violent death is not alone among the passions that make men just. Second, it consists in the will, but not necessarily the act, of fulfilling the natural law.
