Juzgar el pasado en la "provincia de los derechos humanos": las causas por desaparición forzada en Viedma (Río Negro) y el problema de la competencia (1984-1985)

Abstract

El artículo analiza la trayectoria de una serie de expedientes por casos de desapariciones forzadas y torturas iniciada en la justicia federal de Viedma durante 1985 y las disputas que dio el juzgado de aquella ciudad para investigar. Centrado en un territorio alejado de las grandes urbes pero que fue estratégico para el gobierno de Raúl Alfonsín, este estudio a escala reducida tiene como objetivos aportar a la conceptualización sobre lo incierto, lo indefinido y disputado del contexto transicional, y destacar el rol central que tuvieron ciertos actores locales para garantizar justicia, como fue el caso del juez federal Juan Pablo Videla, los organismos de derechos humanos de la provincia y un grupo de víctimas de la capital de Río Negro. La hipótesis es que el juez Videla, relacionado con el movimiento humanitario de la región, hizo lugar a los recelos y temores que existían en este sector en cuanto al problema de la competencia de los tribunales militares para juzgar a los responsables de las violaciones a los derechos humanos y vehiculizó sus expectativas de justicia tensionando los límites del programa del ejecutivo nacional y de la legislación establecida para el tema.

The article analyzes the trajectory of a series of files for cases of enforced disappearances and torture initiated in the federal justice of Viedma during 1985 and the disputes that the city court gave to investigate. Focused on a territory far from the big cities but that was strategic for the government of Raúl Alfonsín, this small-scale study aims to contribute to the conceptualization of the uncertain, undefined and disputed aspects of the transitional context, and highlight the central role that they had certain local actors to guarantee justice, as was the case of the federal judge Juan Pablo Videla, the human rights organizations of the province and a group of victims of the capital of Río Negro. The hypothesis is that judge Videla, related to the region’s humanitarian movement, upheld to the misgivings and fears that existed in this sector due to the problem of the jurisdiction of military courts to prosecute those responsible for violations of the human rights and vehiculated his expectations of justice by tightening the limits of the national executive’s agenda and the legislation established for the subject.
