Control de convencionalidad: El valor de la jurisprudencia de la corte interamericana de derechos humanos en el caso “hábeas corpus seleme” conventionality control

Abstract

Este trabajo tiene como objetivo analizar un caso recientemente resuelto por el Juzgado de Control de Segunda Nominación de la Ciudad de Córdoba, donde se realizó un control de convencionalidad interno fundado en jurisprudencia de la Corte Interamericana de Derechos Humanos. El artículo explora el desarrollo de la figura del control de convencionalidad como mecanismo para garantizar el cumplimiento efectivo de la Convención Americana de Derechos Humanos, enfatizando en su recepción en el ordenamiento jurídico argentino y sus avances a través de la jurisprudencia.

This work aims to analyze a recently resolved case by the Second Nomination Control Court of the city of Córdoba, where an internal conventionality control based on the Inter-American Court of Human Rights’ jurisprudence was realized. The article explores the development of the figure of conventionality control as a mechanism to ensure the effective implementation of the American Convention on Human Rights will be included, giving emphasis on its reception in the Argentine legal system and its progress through jurisprudence.
