Los estereotipos normativos en la decisión judicial: Una exploración conceptual

Abstract

Suele exigirse a los jueces que prevengan o contrasten los efectos perjudiciales de los estereotipos. El autor sostiene que para comprender esta exigencia es necesario advertir que el uso del término estereotipo no es siempre homogéneo. Existe un uso descriptivo cuando el estereotipo atribuye una propiedad a los miembros de un grupo por el solo hecho de pertenecer a ese grupo y existe un uso normativo cuando se atribuye un deber a los miembros de un grupo, por el hecho de pertenecer a ese grupo. En este trabajo se propone distinguir entre estereotipos descriptivos y estereotipos normativos sobre la base de su dirección de ajuste. Asimismo, el autor ofrece un análisis conceptual de los estereotipos normativos a partir de las nociones de convención y constitutividad. Y finalmente se introducen algunos criterios de relevancia destinados a determinar cuándo el uso de estereotipos está prohibido y cuándo es obligatorio.

Judges are often required to avoid or prevent the negative effects of stereotypes. The author claims that to understand this requirement it is indispensable to note that the usage of "stereotype" is not always homogenous. The use is descriptive when it ascribes a property to the members of a group on the mere basis of their belonging to the group. The use is normative when it ascribes a duty to the members of a group on the mere basis of their belonging to the group. In this work the author proposes to distinguish between descriptive and normative stereotypes on the basis of their direction of fit. Likewise, the author offers a conceptual analysis of normative stereotypes based on the ideas of conventionality and constitutivity. Finally, the paper introduces some criteria of relevance in order to determine whether the use of a normative stereotype is prohibited or mandatory.
