Hermes o la continuación de Antígona por otros medios: una crítica del interpretativismo

Abstract

Si bien es innegable que la repercusión del interpretativismo, tanto en el ámbito académico como en el forense, ha sido formidable, se trata de una posición que tiene serias dificultades para acomodar un ingrediente fundamental de todo sistema jurídico, a saber, la autoridad. A continuación entonces, nos centraremos en Law’s Empire, la obra en la cual Dworkin expone la versión interpretativista de su pensamiento jurídico, y describiremos los tres grandes pilares del interpretativismo dworkiniano para luego mostrar algunas de sus deficiencias. Dicho sea de paso, la repercusión del interpretativismo ha sido tal que da la impresión de que, para poder identificar sus tesis principales, ni siquiera hace falta recurrir a la obra de Dworkin, sino que es suficiente observar la práctica judicial actual. De ahí que incluso si, por alguna razón, nuestro retrato no fuera fiel a la obra de Dworkin, sino que resultara ser un 'hombre de paja' – como se suele decir en inglés–, no por ser de paja, este hombre dejaría de ser de interés.

Even though the repercussion of interpretativism in the forensic and academic fields has been undeniably formidable, it is a posture that has serious difficulties to accommodate a fundamental ingredient of every legal system, authority. in the following article, we will center on Dworkin’s Law’s Empire, in which he exhibits the interpretativist version of his legal thought, and we will describe the three pillars of Dworkinian interpretativism, to later show some of its deficiencies. In addition, the repercussion of interpretativism has been such, that it could give the impression that, to identify the main thesis, it is not necessary to use Dworkin's writings, but that it is enough to observe the ongoing legal practice. According to this line of thought, even if, for some reason, our portrait was not faithful to Dworkin's work, but a mere “straw man” it would not mean it loses its value.
