Distinguir donde la ley no distingue: prácticas burocráticas y actuación judicial en torno al sistema de Asignaciones Familiares en contextos de encierro

Abstract

Desde 2009 Argentina masificó el sistema de Asignaciones Familiares con la creación de la Asignación Universal por Hijo (AUH) y también se hicieron cambios y ampliaciones en las tradicionales Asignaciones para trabajadores asalariados. Sin embargo, aquí se analizará un grupo minoritario que no accede a estas prestaciones. Son las madres que conviven con sus hijos menores de 4 años en contexto de encierro, tema que llegó a sede judicial y tuvo sentencia favorable de la Sala IV de la Cámara de Casación Penal.

Since 2009 Argentina has expanded the Family Allowances system with the creation of the Universal Child Allowance and also made changes and extensions in the traditional Assignments of the contributory field. However, a minority group that does not access these benefits will be analyzed here. It is the mothers who live with their children under 4 years of age in the context of confinement, a topic that reached the judicial seat and was granted a favorable ruling by the Chamber IV of the Criminal Cassation Chamber.
