La regulación jurídica de los hidrocarburos en la República Argentina y su adecuación al Derecho Ambiental

Abstract

El objetivo del presente artículo consiste en describir la regulación jurídica de los hidrocarburos en la República Argentina y en analizar si esta regulación se ha adaptado o no a la recepción del derecho a un ambiente sano consagrado en la última reforma constitucional en el país. Se concluye que la regulación ambiental de la actividad hidrocarburífera se encuentra contenida en resoluciones dispersas, pero se carece de una ley de presupuestos mínimos de protección ambiental que regule la temática, tal como manda la Constitución Nacional. Finalmente, se delinean los presupuestos que esta ley debería contener.

The aim of this article is to describe hydrocarbons regulation in Argentina Republic and to analyze if this regulation respects the right to a healthy environment as enshrined by the last amendment of the Constitution in the country. It is concluded that environmental regulation of hydrocarbons is contained in dispersed resolutions, but no law of environmental protection basic requirements regulating the subject has been enacted in the country, as mandated by the National Constitution. Finally, the basic requirements that this law shall include are described.
