La judicialización de la salud mental: una investigación cualitativa sobre experiencias de personas con padecimiento psíquico

Abstract

Este artículo presenta resultados de una investigación social que se propuso comprender las particularidades que adquiere la judicialización a partir de las experiencias de personas con diagnóstico de padecimiento psíquico y restricción de la capacidad jurídica, mediante una recolección de datos de fuentes primarias y secundarias realizada durante el periodo 2015-2018. El objetivo del artículo es caracterizar y analizar las experiencias y trayectorias de las personas con padecimiento psíquico en el ámbito judicial. Esto incluye la comprensión inicial sobre el campo judicial y la experiencia adquirida a lo largo de la trayectoria, las modalidades para lidiar con el campo y resolver distintas situaciones. Asimismo, se analiza la relación que establecen las personas judicializadas con algunos documentos, como son las sentencias y las normativas jurídicas en materia de salud mental y Derechos Humanos. La investigación estipuló la realización de entrevistas semi estructuradas a hombres y mujeres judicializados, y el análisis de expedientes judiciales en la misma institución. Además, se realizaron entrevistas adicionales a profesionales que se desempeñan en el ámbito judicial.

This paper presents the results of a social research about the particularities that the judicialization acquire from the experiences of people with a psychiatric diagnosis and restriction of legal capacity, through a collection of data from primary and secondary sources made during the period 2015-2018. The objective of this paper is to describe and analyze the experiences and trajectories of people with psychic suffering in the legal field. This includes the early comprehension about the legal field and the experience acquired throughout the trajectory, the modalities to deal with the field and the building of the investiture to resolve situations. Also, it analyzes the relationship between the judicialized people with some documents, as for example court judgements and the legal regulations on mental health and Human Rights. The research stipulated the making of semi-structured interviews to men and women represented by the Court System, and the analysis of court dockets in the same institution. Furthermore, additional interviews were made to professional who work in the legal field.
