Le droit administratif français en droit administratif argentin: Réflexions sur un rayonnement doctrinal José Sebastián

Abstract

Le droit administratif français a servi d’inspiration pour plusieurs États enclins à recevoir des systèmes juridiques plus construits que leurs droits nationaux. L’un des destinataires de ce rayonnement fut l’Argentine. En effet, quasiment l’ensemble de grandes notions structurant le système juridique administratif de ce pays témoigne d’emprunts à l’ordre juridique hexagonal. Cette présence administrativiste française est perceptible dans toutes les sources du droit (textes, jurisprudence et doctrine). La présente contribution interroge les conditions de réception de notions provenant d’un autre ordre juridique et les modalités d’adaptation corrélatives de l’ordonnancement destinataire. Dans un premier temps, nous proposons d’analyser ce rayonnement d’un point de vue historique en s’intéressant plus particulièrement aux facteurs qui l’ont favorisé. Dans un second temps, nous considérons la présence du droit administratif français en Argentine en tant que composante de son droit vivant.

French administrative law served as an inspiration for several recipient States of the more constructed institutions than those found within their national laws. One of the recipients of this influence was Argentina. Indeed, almost all the major notions structuring this legal branch testify to the borrowings from the French legal order. It should be noted that this French administrative presence can be found in all sources of law (texts, jurisprudence and doctrine). The present article discusses the receipt of concepts from another legal order and how the recipient’s sequence had to adapt this irradiation. First, we will observe this radiation from a historical point of view as well as the factors which made it possible. Secondly, we will focus on the presence of French administrative law in Argentina as part of its living law.
