Los conflictos por el acceso a la vivienda en la era PRO en la Ciudad de Buenos Aires: Hitos contemporáneos en una tradición de más de un siglo

Abstract

El déficit habitacional constituye un conflicto de larga data en la Ciudad de Buenos Aires que, en el año 2010, se desplaza al centro de la agenda pública a partir de la toma de un espacio público localizado en el sur de la ciudad, con el fin de satisfacer la necesidad de vivienda de un conjunto de familias provenientes de asentamientos informales de la zona. El conflicto por la toma del Parque Indoamericano visibiliza un conjunto de problemáticas vinculadas al acceso a la vivienda de calidad –como el crecimiento poblacional de las villas de la ciudad, el proceso de inquilinización de dichos territorios, la desigualdad entre el sur y norte de la ciudad–, así como una vacancia de las políticas públicas en torno a dichos asuntos. Este artículo de investigación analiza las transformaciones que se observan a partir de este suceso en los modos de articulación de las acciones del Poder Judicial, el Poder Ejecutivo y los movimientos territoriales en el marco de conflictos urbanos vinculados al déficit habitacional en las villas de la Ciudad. En primer lugar, se reconstruye el momento denominado como ciclo de activismo jurídico donde el canal judicial se constituyó como un espacio de disputa de los conflictos urbanos por parte de los movimientos sociales y sus alcances limitados sobre las acciones del Poder Ejecutivo. Tras el conflicto del Indoamericano, se observa un cambio de tendencia en el desarrollo de las políticas en villas y ciertas transformaciones en los canales judiciales como ámbito de disputa. Sin embargo, a pesar de la visibilización de la problemática de estos barrios y de los cambios observados en la orientación de las acciones del gobierno de la ciudad, el déficit habitacional en la Ciudad de Buenos Aires continúa siendo aún una cuestión urgente y persistente.

The housing deficit constitutes a long-standing conflict in the City of Buenos Aires that, in 2010, moved to the center of the public agenda from the taking of a public space located in the south of the city, in order to satisfy the housing need of a group of families from informal settlements in the area. The conflict over the seizure of the Indo-American Park reveals a set of problems related to access to quality housing - such as the population growth of the city’s villas, the process of re-occupation of said territories, the inequality between the south and north of the city- as well as a vacancy of public policies regarding said issues. This article analyzes the transformations that are observed from this event in the ways of articulating the actions of the Judicial Power, the Executive Power and the territorial movements in the framework of urban conflicts linked to the housing deficit in the towns of the City. In the first place, the moment known as the cycle of legal activism where the judicial channel was constituted as a space for dispute of urban conflicts by social movements and their limited scope on the actions of the Executive Power is reconstructed. After the Indo-American conflict, there is a change of trend in the development of policies in towns and certain transformations in judicial channels as an area of dispute. However, despite the visibility of the problems in these neighborhoods and the changes observed in the orientation of the actions of the city government, the housing deficit in the city of Buenos Aires continues to be an urgent and persistent issue.
