La mediación como una instancia de la justicia restaurativa: sentidos, interpretaciones y valoraciones

Abstract

Este texto es un registro parcial de la construcción de un objeto de investigación: la mediación como forma específica de administración de conflictos. Se trata de una técnica que pretende desplazarse del sentido de justicia tradicional y se enmarca en las experiencias promovidas por la denominada justicia restaurativa. La propuesta es realizar un análisis sobre las valoraciones, interpretaciones y resignificaciones de la justicia restaurativa y de la mediación en tanto estrategia restaurativa, a partir de la observación del despliegue discursivo de algunos actores estatales y no estatales, nacionales e internacionales, que promueven y motorizan la adopción de estas estrategias en diversas acciones de sensibilización, capacitación y discusión. Para ello me basaré en el material de diferentes cursos de mediación que yo misma he tomado; me detendré en la descripción y análisis de la técnica de la mediación y en la identificación de los sentidos y valores asociados a esta técnica. Luego, me centraré en las discusiones y debates surgidos en una mesa temática sobre medios alternativos de resolución de conflictos en la que he participado como expositora y comentarista en el marco de una jornada sobre Acceso a la Justicia y Derechos Humanos. Por último, traeré algunas cuestiones que me llamaron la atención surgidas en un taller sobre Justicia Restaurativa orientado a la justicia penal para adolescentes y finalizaré con un apartado de síntesis en el que intentaré poner en relación estas tres microescenas interconectadas.

This text is a partial record of the construction of an object of research: mediation as a specific form of conflict management. It is a technique that departs from the understanding of traditional justice and builds on the experiences provided by what is known as restorative justice. The aim is to conduct an analysis of the values, interpretations, and resignifications of restorative justice and of mediation as a restorative strategy, based on an observation of the discursive unfolding of some state and non-state actors, both national and international, that fuel and promote the adoption of these strategies in various instances of awareness, training, and discussion. To this end, I will base my analysis on different materials extracted from mediation courses that I myself have attended, placing special emphasis on the description and analysis of the technique of mediation and the identification of the meanings and values associated with this technique. Next, I will focus on the discussions and debates that emerged in a discussion panel on alternative means of conflict resolution, in which I participated as a speaker and commentator in the context of a conference on Justice and Human Rights Access. Finally, I will address some issues that attracted my attention from a workshop on Restorative Justice oriented toward juvenile criminal justice and will conclude with a synthesis in which I will try to connect these interconnected micro-scenes.
