Lawfare y neoliberalismo en America Latina: una aproximación

Abstract

El artículo brinda un panorama general sobre el lawfare en América Latina desde una perspectiva crítica e interdisciplinar, en un intento de situar el concepto en el marco de estudios previos a nivel internacional, y considerando el contexto y los procesos en América Latina. Se plantea el rol del lawfare como componente de unas relaciones internacional asimétricas y como mecanismo clave en la manufacturación de consenso (construcción de hegemonía) a favor de relatos y prácticas asociadas al libre mercado, impulsadas especialmente desde EE.UU. hacia la región. Se abordan los casos de Brasil y Ecuador, con el objetivo de mostrar los actores, ámbitos e intereses que confluyen en esta guerra por la vía judicial, que alberga también aspectos geopolíticos, en general menos visibles. Se cierra postulando el lawfare como herramienta utilizada por la derecha (liberal o conservadora) para apropiarse del Estado y (re)orientarlo hacia el neoliberalismo, recuperando el componente antipolítico característico de ese orden.

The article provides an overview of lawfare in Latin America from a critical and interdisciplinary perspective, in an attempt to place the concept within the framework of previous international studies, and considering the context and processes in Latin America. The lawfare is understood as a component of asymmetric international relations and as a key mechanism in the manufacture of consent (hegemony) in favor of discourses and practices associated with the free market, promoted especially in the United States and projected along the region. The cases of Brazil and Ecuador are addressed, with the aim of showing the actors, areas and interests that converge in this war fought through the judicial channels, which also contains geopolitical aspects, in general less visible. It closes by postulating lawfare as a tool used by the right wing-politics (liberal or conservative) to appropriate the State and (re) orient it towards neoliberalism, recovering the antipolitical component characteristic of that order.
