La revocatoria de mandato a nivel subnacional en Argentina: Normativa y casos

Abstract

En Argentina, la revocatoria de mandato solo existe en algunas regulaciones subnacionales pero no en la Constitución nacional. Ello explica la multiplicidad y diversidad de formas y requisitos que dicho mecanismo adquiere en las distintas normas provinciales, municipales y locales. Tal situación hace complejo y desalienta su abordaje, atentando contra todo intento de desplegar una mirada comparativa, en forma simultánea y conjunta, a lo largo del territorio. Por ese motivo, el estudio de tal herramienta de participación ciudadana suele fragmentarse en investigaciones parciales de casos, en este país, con una perspectiva particular y aislada de los demás distritos. Se pierde así la posibilidad de hallar elementos similares y diferentes que aporten a una mejor comprensión, no solo del diseño y resultados de la revocatoria a escala micro, sino también de su desempeño general a nivel macro. Reducir esa deuda pendiente para la Argentina es el objetivo de este trabajo.

In Argentina, the recall only exists in some subnational regulations but not in the national Constitution. This explains the multiplicity and diversity of forms and requirements that this mechanism acquires in the different provincial, municipal and local regulations. Such a situation complicates and discourages its approach, undermining any attempt to display a comparative view, simultaneously and jointly, throughout the territory. For this reason, the study of such a citizen participation tool is usually fragmented into partial case investigations in this country, with a particular perspective isolated from the other districts. The possibility of finding similar and different elements that contribute to a better understanding is lost, not only of the design and results of the recall on a micro scale, but also of its overall performance at the macro level. Reducing that outstanding debt for Argentina is the objective of this work.
