Estudios críticos del lenguaje jurídico: Propuestas para su análisis desde la filosofía del derecho

Abstract

Desde los aportes metodológicos que ofrece la filosofía crítica del derecho, el presente trabajo tiene como objetivo el análisis de determinadas categorías en torno a la formación y despliegue del lenguaje jurídico. En contraposición a las perspectivas que intentan reducirlo a un aspecto meramente normativo, se entenderá el saber jurídico como un fenómeno signado por la complejidad. No solo se propone visibilizar la disposición estructural que adopta el discurso legal en términos formales sino la funcionalidad que proyecta en el ámbito social. El estudio se desarrolla a través de una metodológica comprensivista, cualitativa e histórica, en tanto se proyecta la exposición de los vínculos entre el lenguaje y el derecho a lo largo del tiempo. Se tienen en cuenta los marcos interpretativos ofrecidos por los aportes teóricos que analizan la relación "derecho y lenguaje" y las herramientas conceptuales que proponen los estudios críticos del discurso, a los fines de desarticular el hermetismo y opacidad que detenta el lenguaje jurídico. Para ello es necesaria una identificación de sus enunciados a los fines de poder entrever los vínculos con otros discursos, las prácticas de los operadores jurídicos y su posterior articulación en el imaginario social.

From the methodological contributions offered by the critical philosophy of law, this paper analyzes certain categories around the formation and deployment of legal language. In contrast to the perspectives that try to reduce it to a merely normative aspect, the study understands legal knowledge as a phenomenon marked by complexity. It is not only proposed to make visible the structural disposition adopted by the legal discourse in formal terms, but also the functionality it projects in the social sphere. The study employs a comprehensive, qualitative and historical methodology, while projecting the exposure of the relationships between language and law over time. We take into account the interpretative frameworks offered by the theoretical contributions that analyze the relationship “law and language” and the conceptual tools proposed by critical discourse studies, in order to dismantle the opacity that legal language holds. For this, an identification of their statements is necessary, in order to demonstrate the links with other discourses, the practices of the legal operators and their subsequent articulation in the social imaginary.
