Prácticas tratamentales en el Servicio Penitenciario Federal: El cuerpo Profesional y la Política Penitenciaria Nacional

Abstract

El artículo propone describir, a través de un estudio cualitativo, las prácticas tratamentales en cárceles federales desde la perspectiva de los/as profesionales que las llevan a cabo. Así es como tras contextualizar la política penitenciaria, identificando tres momentos emblemáticos: la cárcel peronista, el Plan Director de la Política Penitenciaria Argentina (1995) y el Plan Estratégicooperativo (2016-2020), surge que las acciones y los discursos de los/as agentes penitenciarios/as del escalafón profesional del Servicio Penitenciario Federal, en la actualidad, echan mano a valores e ideas provenientes de todos esos paradigmas; los que aun siendo diversos, conviven sin conflicto en la práctica cotidiana en los penales. La importancia de conocerlas y analizarlas radica en que son éstas las que orientan la forma en que las personas detenidas transitan la cárcel, al dar fundamento tanto a aquello que reciben como “tratamiento” como a la elaboración de todos los argumentos que tienen efectos concretos en el otorgamiento de salidas anticipadas al cumplimiento efectivo de las penas, derecho previsto en la ley de ejecución penal vigente.

The article proposes to describe, through a qualitative study, the treatment practices in federal prisons from the perspective of the professional officers who carry them out. After contextualizing the prison policy by identifying its three emblematic moments: the Peronist prison, the Director Plan of the Argentine Penitentiary Policy (1995) and the Strategic-Operational Plan (2016-2020), it emerges that the actions and speeches of the prison officers from professional ranks of the Federal Penitentiary Service, at present, make use of values and ideas from all these paradigms built in those three moments; which, although they are diverse and even contradictory, coexist without conflict in daily practice in prisons. The importance of knowing and analyzing these values and ideas lies in the fact that they are the ones that guide the way in which detainees go through prison, by giving a background both to what they receive as “treatment” since the elaboration of all the arguments that have concrete effects the bestowal of early departures to the effective fulfillment of the penalties, right provided for in the current criminal enforcement law.
