Los silencios del Derecho: Estudios iusfilosóficos y literarios del discurso jurídico

Abstract

Desde las herramientas metodológicas que ofrecen los análisis iusfilosóficos de “derecho y literatura”, el presente artículo se propone indagar en torno a los silencios e indeterminaciones semánticas que se encuentran en el discurso jurídico. El derecho se despliega desde un lenguaje que se presenta en apariencia estable y hermético pero que, sin embargo, expone conceptos y espacios caracterizados por la ausencia de definiciones unívocas. Un estudio interdisciplinario en torno al tópico del silencio, permite visibilizar otras narrativas que emergen por fuera del derecho, al mismo tiempo que plantean su resignificación. Las categorías teóricas ofrecidas por la literatura permiten examinar la construcción y despliegue de los silencios en el derecho. Los conceptos estructurales de ley, sujeto, resocialización, sana crítica, cosa juzgada, libertad, orden, fuerza o poder, serán desarrollados y constituidos desde el derecho pero expuestos y desarticulados por la posición perspectiva de la literatura.

Based on the methodological tools provided by the iusphilosophical studies of “law and literature”, this article aims to investigate the silences and semantic indeterminacies in legal discourse. The law unfolds from a language that appears stable and hermetic but that nevertheless exposes concepts and spaces characterized by the absence of univocal definitions. An interdisciplinary study around the topic of silence, makes visible other narratives that emerge outside the law, at the same time that they propose their resignification. The theoretical categories offered by the literature allow us to examine the construction and deployment of silences in law. The structural concepts of law, subject, resocialization, sound criticism, res judicata, freedom, order, force or power, will be developed and constituted from the law but exposed and disjointed by the perspective position of literature.
