“Elevar nuestra voz a los constituyentes”: Las peticiones de mujeres ante la reforma constitucional de 1949

Abstract

La constitución argentina de 1949 fue la expresión local del movimiento del constitucionalismo social. Aunque derogada por el gobierno de facto de 1955, la reforma de 1949 representa un hito fundamental de la historia constitucional argentina que, a más de 70 años, sigue presentando numerosos interrogantes. Uno de ellos es la pregunta acerca del rol de las mujeres y el reconocimiento de sus derechos en este proceso. Este trabajo indaga en las peticiones que los colectivos de mujeres hicieron llegar a la asamblea constituyente de 1949 para hacer conocer sus reclamos y solicitudes. Nuestra investigación recupera las voces de las mujeres que, aunque silenciadas por el discurso oficial, estuvieron presentes en todas las etapas del proceso constituyente. Buscamos aportar, por una parte, una perspectiva de género y “desde abajo” a la historia constitucional de Argentina y, por otra, un diálogo con la historia de las mujeres desde una perspectiva histórico-jurídica, ofreciendo un análisis sobre un acervo documental inexplorado a la fecha.

The constitutional reform of 1949 was the local expression of the social constitutionalism movement. Although repealed by the de facto government of 1955, this constitution represents a key milestone in Argentine constitutional history. However, it is possible to affirm that 70 years after this constituent process, many questions remain unanswered. One of them is the question about the role and recognition of women's rights in the framework of this reform. This work addresses this aspect by analyzing the petitions that women's groups sent to the Constituent Assembly of 1949. Our research recovers the voices of women who, although silenced by official speeches, were present in all stages of the constituent process. We seek to contribute, on the one hand, a gender perspective and a “bottom-up” approach to the constitutional history of Argentina and, on the other hand, a dialogue with the history of women from a historical-legal perspective, offering an analysis of a documentary heritage unexplored to date.
