El caso Viola: una aproximación al funcionamiento de la Justicia en tiempos del Operativo Independencia (Tucumán, Argentina)

Abstract

En este artículo analizaremos la causa judicial que se tramitó en la Justicia para investigar el asesinato de un capitán del Ejército, Humberto Viola y su hija, en la provincia de Tucumán, Argentina, en manos del Partido Revolucionario de los Trabajadores-Ejército Revolucionario del Pueblo (PRT-ERP). Este fue un caso emblemático de la violencia política sucedido el 1 de diciembre de 1974; funcionó creando un clima castrense de odio y de venganza hacia el PRT-ERP y alentando un fuerte compromiso del Ejército con la represión ilegal que se desplegaría en el marco del Operativo Independencia (una campaña militar desarrollada en Tucumán, donde se ensayó una política estatal de desaparición forzada de personas, un año antes del golpe de Estado). Este expediente permite analizar el funcionamiento de la Justicia durante dicha campaña militar y la última dictadura, así como la articulación entre los aspectos visibles e ilegales de la represión política.Revista indexada con doble referato.

In this article, we will analyze the judicial case that was taken to the Courts in order to investigate the murder of an Army captain, Humberto Viola, and his daughter, in the province of Tucumán, Argentina, committed by the Workers Revolutionary PartyPeople’s Revolutionary Army (prt-erp). This was an emblematic case of political violence that took place on December 1st, 1974, it worked by creating a military atmosphere of hatred and revenge towards the prt-erp and encouraging a strong commitment by the Army to the illegal repression that was deployed in Operation Independence (a military campaign carried out in Tucumán, where a State policy of forced disappearance of persons was implemented, a year before the coup d’état). This case file allows us to analyze how Justice worked during Operation Independence and the last military dictatorship, as well as the interaction between the visible and illegal aspects of the political repression.
