Acerca del fetichismo de la ley

Abstract

La propuesta de nuestro artículo atiende a la problemática de la fetichización de la ley a partir de las hermenéuticas de dos vertientes, que lejos de contraponerse, se enriquecen mutuamente. La primera vertiente, pone el acento en la tradición filosófica y psicoanalítica y toma como punto de partida al pensamiento kantiano, especialmente en lo que respecta al formalismo de la ley, cristalizado en el imperativo categórico moral kantiana y sus implicancias en lo que respecta a la política. En tal sentido, será central como parte nodal del trabajo, las críticas que dicho formalismo recibirán de Adorno, Hegel y Lacan. La segunda vertiente, vinculada a la reflexión teológica-bíblica, tomará específicamente el aporte crucial de Franz Hinkelammert a partir de analizar un mito fundante como lo es el célebre pasaje bíblico del sacrificio de Abraham y cómo aquel fue leído por la tradición y reactualizado por la Teología de Pablo de Tarso, especialmente a partir del análisis de un célebre fragmento de la carta paulina a los Romanos.

The aim of this article is to explore the problem regarding the fetishization of law by examining the hermeneutics of two traditions that, far from being opposed, mutually enrich each other. The former puts forward both philosophical and psychoanalitical traditions, addressing Kantian thought, particularly with respect to law’s formalism, illustrated in the categorial imperative and its implications on politics. Therefore, we will stress the relevance of the different critics such formalism received from Adorno, Hegel and Lacan. The latter, linked to a theological-biblical thought, will take into account Franz Hinkelammert’s crucial contribution, analyzing Abraham’s sacrifice myth, which was interpreted by the tradition, and updated by Pablo de Tarso’s Theology, especially stydying a well-known passage from the paulin letter to the Romans.
