¿20 años no es nada? Un estudio de los debates constituyentes de 1994 sobre ambiente y patrimonio cultural

Abstract

El objetivo de la presente contribución consiste en revisitar algunas problemáticas que formaron parte de los debates constitucionales desarrollados en el contexto de la reforma de 1994 y, en particular, sobre algunos aspectos del texto del artículo 41 incorporado en el apartado Nuevos Derechos y Garantías. A partir del análisis de un corpus de documentos conformado por las versiones taquigráficas de los debates producidos en el seno de la Convención Constituyente se pretende recuperar algunos interrogantes que interpelaban a los constituyentes, en especial respecto de la perspectiva ética subyacente para pensar la problemática ambiental así como sobre el concepto de patrimonio cultural. Este rescate se realiza desde un enfoque histórico y, al mismo tiempo reconsiderando críticamente las perspectivas y conceptos a través de los cuales procuraron darles respuesta a la luz de debates y miradas contemporáneas que poseen especial relevancia en el ámbito latinoamericano.

intec en santa feThe aim of the present contribution consists in re–visiting some problematic that formed part of the constitutional debates developed in the context of the reform of 1994 and, especially, on some as-pects of the text of the article 41 incorporated in the paragraph “New Rights and Guarantees”. From the analysis of a corpus of documents shaped by the shorthand versions of the debates produced in the bosom of the Constituent Convention, es-pecially the discussions concern of the ethical underlying perspective to think the environmental problematic as well as on the concept of cultural heritage. This rescue is realized from a historical approach and, at the same time, reconsidering critically the perspectives and concepts that have a special relevance in the Latin–American context.
