Cristina Fernández y el Poder Judicial: Apuntes sobre un vínculo –discursivo– conflictivo

Abstract

En este artículo se estudiaron, a través del análisis del discurso de la expresidenta argentina Cristina Fernández de Kirchner, los modos en que se construyó su vínculo con el Poder Judicial de la Nación Argentina. A partir de la exploración del aspecto polémico del discurso, se sostiene que dicho vínculo puede ser comprendido por lo que se denominó como renominación fundante: el momento político y discursivo en que Fernández comenzó a denominar al Poder Judicial como “Partido Judicial”. El corpus de análisis se conformó a partir de un conjunto de discursos que se referían a tres acontecimientos que tematizaban dicha relación: la Reforma Judicial de 2013, la muerte del fiscal Alberto Nisman en 2015 y las sucesivas denuncias judiciales contra Fernández de Kirchner. Debido a que lo discutido son asuntos vinculados con la separación de poderes, reflexionar sobre estos lazos ayuda a pensar, nada más y nada menos, que la propia democracia.

This article studied, through the analysis of the speech of former Argentine President Cristina Fernández de Kirchner, the ways in which her link with the Judiciary of the Argentine Nation was built. From the exploration of the controversial aspect of the discourse, it is argued that this link can be understood by what was called the founding renomination: the political and discursive moment in which Fernandez began to call the judiciary the “Judicial Party”. The corpus of analysis was made up of a set of speeches that referred to three events that highlighted this relationship: the judicial reform of 2013, the death of prosecutor Alberto Nisman in 2015 and the successive judicial complaints against Fernández de Kirchner. Because what is being discussed are issues linked to the separation of powers, reflecting on these links helps to think about democracy itself.
