La Defensa Nacional en la Constitución de 1949

Abstract

El objetivo del presente trabajo es abordar las cláusulas relativas a la defensa nacional de la Constitución Nacional de 1949. A diferencia de lo que sucedió en otras Convenciones Constituyentes, la defensa nacional fue un tema central de la reforma, según lo resaltó el propio Arturo Sampay. Sin embargo, no es tratado suficientemente en la literatura sobre el tema. Para estudiarlo en profundidad, se analizarán tres textos importantes de la época: uno de Juan D. Perón de 1944, el discurso de Sampay en la Convención Constituyente y, finalmente, el del presidente de la Corte Suprema de Justicia, Rodolfo Valenzuela, en 1954. A través del análisis de estos textos es posible comprender mejor las razones que tenían los actores de ese tiempo para explicar las modificaciones constitucionales sobre defensa nacional.

This essay aims to study the clauses related to national defense on the 1949 Constitution. As Arturo Sampay noted, contrary to other Constituent Conventions in Argentina, national defense was a fundamental issue in this reform. However, scholars have not studied the topic systematically. To do it, we analyze three important texts: one by Juan D. Perón from 1944; the other is the speech by Sampay in the Convention; and finally, a 1954 piece by Rodolfo Valenzuela, president of the Supreme Court of Justice. Through the analysis of these pieces, a better understanding is possible on the reasons that the actors of that time had to explain the constitutional modifications on national defense.
