De injerencias y autonomías: Los acuerdos entre el Estado y la Santa Sede en Argentina

Abstract

Los Acuerdos y Concordatos entre los Estados y El Vaticano son instrumentos jurídicos a nivel internacional destinados a regular las relaciones entre el poder civil y la Iglesia Católica. Históricamente, la firma de estos convenios ha permitido entrelazar las áreas de injerencia del poder político y de la Iglesia Católica y distinguir a esta última del resto de las entidades religiosas presentes en los territorios nacionales. En este trabajo, intentaremos repasar los diferentes tratados entablados entre los países y la Santa Sede, para luego adentrarnos en el análisis del caso argentino. El Acuerdo entre el gobierno argentino y el poder central de la Iglesia Católica, rubricado en 1966, tuvo la particularidad de anular las injerencias del poder civil en la órbita eclesiástica, garantizando la plena autonomía de la Iglesia Católica; sin afectar las prerrogativas del catolicismo como culto oficioso, provenientes del régimen del Patronato y del derrotero histórico de la imbricada relación entre el Estado y la institución religiosa.

The Concordats between States and the Vatican are international legal instruments aimed at regulating relations between the civil power and the Catholic Church. Historically, the signing of these pacts has allowed to link intervention areas of political power and Catholic Church. It has also enabled to distinguish the Catholic institution from other religious organizations present in the national territories. In this paper, we will review the variety of treaties negotiated between the countries and the Holy See; in a following step, we will analyze the Argentinian case. The agreement between the Argentine government and the Vatican, signed in 1966, had the peculiarity of canceling the interference of the civil power in ecclesiastical field. This Concordat ensures full autonomy of the Catholic Church, without affecting its privileges as ‘officious’ national worship, derived from the Patronage Regime and the symbiotic relationship between the State and the religious institution.
