Estrategias de erosión del poder sindical en Argentina: Un análisis del período 2015-2018

Abstract

El artículo analiza las estrategias del Ministerio de Trabajo, Empleo y Seguridad Social (MTEySS) y el accionar del poder judicial frente a las organizaciones sindicales bajo la hipótesis que éstas estuvieron orientadas a generar un proceso de disciplinamiento por vía institucional. Para ello se han relevado disposiciones y resoluciones del MTEySS como así también fallos judiciales entre diciembre del 2015 y septiembre 2018, fecha en la que el Ministerio fue degradado a nivel de Secretaria de gobierno. Esta información permite comprender la estrategia llevada adelante por el Estado en materia gremial y en particular el modo en que se articulan prácticas antisindicales, pero también las contradicciones y alcances en su accionar al momento de comparar las estrategias de ambas instituciones.

The article focuses on both the Ministry of Labor, Employment and Social Security (MTEySS) strategies and decisions of the Judiciary, through a number of emblematic cases, under the hypothesis that they were aimed at disciplining trade union organizations. To this end, provisions and resolutions of the MTEySS and judicial decisions have been relieved, from December 2015 to September 2018, when (MTEySS) was downgraded to the administrative level of Secretary. This flow of information allows us to understand the strategy carried out by the State in labor union matters and in particular the way in which anti-union practices were implemented.
