¡Juicio a los revolucionarios! Represión penal y tribunal especial del poder judicial en Argentina (1971-1973)

Abstract

En este artículo se examinan la creación y el funcionamiento de un instrumento específico del poder judicial ordinario, que tuvo por objetivo primordial la persecución y represión del delito político en Argentina entre 1971 y 1973. Se sostiene que este tribunal especial contribuyó en forma directa a legitimar la represión estatal de una dictadura militar. La Cámara Federal en lo Penal de la Nación fue establecida en un contexto de fuerte radicalización social y actividad de grupos guerrilleros. Aquí se analizan conjuntamente el perfil social, profesional, de edad y género de los activistas que estuvieron en la mira de este aparato represivo y los materiales que fueron secuestrados en el marco de las investigaciones judiciales. Se concluye que esta fue una estrategia represiva original, y que, si bien su atención se dirigió principalmente a los integrantes de grupos guerrilleros, también penalizó y condenó a otros activistas sociales y sindicales.

This article examines the creation and functioning of a specific tool of the ordinary judicial branch of the State, whose main objective was the persecution and repression of political crimes in Argentina between 1971 and 1973. It maintains that this special court directly helped to legitimize State repression under a military dictatorship. The Cámara Federal en lo Penal de la Nación was established in the context of a strong social radicalization and the activities of guerrilla groups. It jointly analyzes the social and professional profiles, age and gender of the activists who were in the sights of this repressive apparatus and the materials which were seized in the framework of the judicial investigations. It concludes that this was an original repressive strategy, and while it was mainly focused on the members of guerrilla groups, it also sanctioned and convicted other social and trades union activists.

Neste artigo analisa-se a criação e o funcionamento de um instrumento específico do poder judicial ordinário, que teve como objetivo primordial a perseguição e repressão do delito político na Argentina, entre 1971 e 1973. Defende-se que esse tribunal especial contribuiu de forma direta para legitimar a repressão estatal de uma ditadura militar. A Cámara Federal en lo Penal de la Nación foi estabelecida em um contexto de forte radicalização social e atividade de grupos guerrilheiros. No presente artigo são analisados conjuntamente o perfil social, profissional, etário e de gênero dos ativistas que estiveram na mira desse aparato repressivo e dos materiais que foram sequestrados no âmbito das investigações judiciais. Conclui-se que essa foi uma estratégia repressiva original e que, por mais que a sua atenção estivesse dirigida principalmente aos integrantes dos grupos guerrilheiros, também penalizou e condenou outros ativistas sociais e sindicais.
