Cuando los poderes se encuentran, los actores confrontan. Elementos para analizar los Jurys hacia el interior de la justicia penal

Abstract

Con este trabajo intentaremos aportar, a partir de una serie de entrevistas realizadas a actores pertenecientes a la justicia penal de la provincia de Buenos Aires en la república Argentina, elementos con los cuales comprender mejor las percepciones y los efectos que ocasiona para ellos un Jury. Se trata de un abordaje cualitativo y exploratorio que no pretende apelar a fundamentos históricos o criterios comparativos. En primer lugar, analizaremos la carrera judicial como trayectoria laboral en la que se destaca una progresión de jerarquías a lo largo de los años por medio de la cual los actores van ocupando cargos de menor a mayor relevancia. Luego sugeriremos que el tradicional concepto de familia judicial parece estar más ligado a una representación pública sobre la justicia penal que se desentiende de los escepticismos privados que poseen los operadores jurídicos sobre la misma. En tercer lugar, desde la sociología de la justicia penal, consideraremos importante pensar a esta última no sólo en términos de independencia como se lo suele hacer sino también de autonomía. Por último, mencionaremos tres cuestiones relevantes que aparecen en los testimonios de los actores judiciales para interpretar el problema de dicha autonomía: el tipo de causas que se estén investigando, el voluntarismo de los actores judiciales y los atributos de la institución penal.

In this paper, we will attempt to provide elements from a series of testimonies given by criminal justice actors, with which we may better understand the insights and effects derived from a Jury from their perspective. This is an exploratory approach which does not intend to appeal to any historical rationale or comparative criteria. Firstly, we shall examine the judicial career as a professional path in which a progression of hierarchies over the years stands out allowing actors to climb up from low to high positions. Secondly, we shall suggest that the traditional concept of “judicial family” seems to be more associated with a public representation over criminal justice eluding the private skepticism that legal agents have about it. Thirdly, from the sociology of criminal justice viewpoint, we find it important to explore this justice not only in terms of independence, as it is usually the case, but also in terms of autonomy. Lastly, we shall mention three relevant aspects that arise from the testimonies of judicial actors to interpret the problem of its autonomy: the type of cases under investigation, the voluntarism showed by judicial actors and the attributes of the criminal institution.
