"Sicut ex equa et asino". Mulos, presunciones y ficciones jurídicas en un símil de Baldo de Ubaldis

Abstract

Este trabajo se propone analizar un símil empleado por Baldo de Ubaldis para dar cuenta de las combinaciones de presunciones para obtener plena prueba. En él recurre al imaginario de la hibridación de especies. Partiendo de la teoría restrictiva que los juristas medievales desarrollan en torno a la combinación de artificios jurídicos, se trata de explorar las relaciones entre el principio del derecho fictio non parit fictionem y las coordenadas de la cosmología medieval con sus tratamientos diferenciados de lo natural y lo artificial. Para ello se contextualiza vinculando el citado principio con dos fórmulas homólogas del mundo letrado medieval, pecunia pecuniam non parit y affinitas non parit affinitatem. A partir de la relación que los juristas establecen entre las ficciones y la naturaleza y la reflexión consciente en torno de su artificialidad, se trata de pensar qué operaciones jurídicas se proscriben como una suerte de teratologización en tanto reproducción autónoma de lo artificial.

This paper intends to analyze a simile used by Baldus de Ubaldis to describe the combinations of presumptions to obtain full proof. There he resorts to the imaginary of species hybridization. Starting from the restrictive theory that medieval jurists develop about the combination of legal devices, the goal here is to explore the relationships between the principle of law fictio non parit fictionem and the coordinates of medieval cosmology with its differentiated treatments about the natural and the artificial entities. For this reason, this paper aims to contextualize by linking the aforementioned principle with two homologous formulae of the medieval literate world, pecunia pecuniam non parit and affinitas non parit affinitatem. From the bond established by jurists between fiction and nature and the conscious reflection on its artificiality, this paper seeks to examine which legal operations are proscribed as a kind of teratologization, as an autonomous reproduction of the artificial.
