Las Buropatías como Límites al Acceso a Justicia en el Sistema Judicial Penal Juvenil de Santa Fe, Argentina

Abstract

El presente artículo presenta resultados de una investigación en torno al papel de los agentes judiciales en materia penal-juvenil en la Provincia de Santa Fe (Argentina). A pesar de los cambios legales, institucionales y conceptuales ocurridos desde 1989, con la incorporación de la Convención Internacional de los Derechos del Niño (CIDN) al sistema normativo nacional, encontramos dificultades persistentes para desmontar el andamiaje del sistema tutelar orientado al control social de los jóvenes más vulnerables. El análisis adquiere relevancia por cuanto el trato institucional, es condición de posibilidad del acceso a justicia. La metodología utilizada es de corte cualitativo y flexible, a partir del análisis de contenido de narrativas obtenidas en entrevistas abiertas, extensas y recurrentes. El panorama no resulta alentador, y las limitaciones encontradas reducen el margen de maniobras para cualquier intento de reforma procesal, conspirando contra la realización de los principios actuales de la justicia juvenil.

This article presents research results on the role of judicial officers in the criminal-juvenile field in the Province of Santa Fe (Argentina). Despite the legal, institutional and conceptual changes since 1989, with the incorporation of the International Convention on the Rights of the Child to the national regulatory system, we find persistent difficulties in dismantling the scaffolding of tutelary system aimed at social control of the most vulnerable youth. The analysis becomes relevant because the institutional treatment is a condition of access to justice. The methodology used is qualitative and flexible, parting from the content analysis of narratives obtained in open, extensive and recurrent interviews. The outlook is not encouraging, and the limitations encountered reduce the margin of maneuver for any attempt of procedural reform, conspiring against the realization of the current principles of juvenile justice.
