Lenguaje y teoría del derecho. Tensiones en una variante de realismo jurídico

Abstract

El positivismo jurídico como enfoque, en general, y el realismo jurídico en particular siguen al menos tres variantes filosóficas: el empirismo, el naturalismo y el pragmatismo. El realismo jurídico contemporáneo tiene múltiples variantes. Se habla de realismo norteamericano, escandinavo e italiano. Sin embargo, las corrientes del realismo jurídico no suelen seguir completamente a las teorías filosóficas. Más bien siguen algunas tesis, abandonan otras, y desarrollan algunas tesis propias complementarias. El presente trabajo se ocupa de una variante del realismo jurídico (el llamado ?genovés?) e intenta mostrar que las tesis que éste movimiento sostiene generan numerosas tensiones. Lo que aquí se sostiene sobre el realismo analizado tiene relevancia, a su vez, sobre lo que se conoce como positivismo jurídico en cuanto enfoque. Legal positivism in general and legal realism in particular tend to follow at least three philosophical theories: empirism, naturalism and pragmatism. Contemporary legal realism has multiple variants: american, escandinavian and italian.The differents sorts of legal realism not always embrace the totality of a given philosophical theory. Rather, they tend to embrace some thesis, to abandon others, adding to the general theory their own ones. This paper analyzes a variant of legal realism (so called 'legal realism from Genova') and try to show that its main thesis generate a cluster of tensions. Some of the tensions that will be remarked here are relevant for legal positivism in general.
