Los Hijos de Belial. Paradigma religioso y criminalidad en el Río de la Plata hacia fines del siglo XVIII

Abstract

En el presente estudio se busca exhibir la conexión entre delito y pecado desde la historia jurídica y la historia conceptual, tomando como base un caso de "desobediencia del padre" ocurrido en Buenos Aires hacia fines del siglo XVIII. Ello implica, por un lado, la reconstrucción de los conceptos jurídicos en clave religiosa para evidenciar las lógicas del gobierno y sus justificaciones a la luz del mandamiento de obediencia, y rescatando la figura del Padre. Por otra parte, supone el estudio de la potestad jurisdiccional y la patria potestad en el ejercicio del orden local y, asimismo, conlleva la reconstrucción de los sistemas de legitimación de dicho orden, en relación con las disciplinas morales de la ética, la Oeconómica y la política.

The present study aims to show the connection between crime and sin from legal and conceptual history, taking as a basis a case of "disobedience of the father", that took place in Buenos Aires in the late eighteenth century. This implies, in first place, the reconstruction of the legal concepts from the religiousness to demonstrate the logic of the government and its justification in the light of the commands of obedience, and rescuing the figure of the Father as a figure of order. On the other hand, that involves the study of the relationship between judicial structure and parental authority in the exercise of local order, under the light of a system of order based on moral disciplines of ethics, Oikonomics and politics.
