Migrantes y derecho a la igualdad como derecho humano. Aproximaciones para el estudio de las legislaciones argentina y colombiana en materia de trasplantes de órganos en pacientes extranjeros

Abstract

El presente trabajo tiene como objetivo reflexionar en torno al derecho a la igualdad y no discriminación como derecho humano. En concreto, se examinaran las normativas argentina y colombiana que regulan el acceso a trasplantes de órganos en atención a que ambas legislaciones exigen diferentes requisitos según el paciente sea nacional o extranjero. A continuación se analizarán las legislaciones mencionadas a la luz de los estándares elaborados por la Corte Interamericana de Derechos Humanos a lo largo de su jurisprudencia en materia de igualdad y no discriminación (vinculantes para ambos Estados por ser parte de la Convención Americana sobre Derechos Humanos y por haber aceptado la competencia de la Corte Interamericana) con la intención de observar si los Estados de Colombia y Argentina son respetuosos (o no) del principio de igualdad y si, por tanto, superan satisfactoriamente un control de convencionalidad en la materia.

The objective of this paper is to reflect on the right to equality and non-discrimination as a human right. In particular, the Argentine and Colombian regulations that regulate access to organ transplants will be examined, given that both laws require different requirements depending on whether the patient is a national or a foreigner. The aforementioned legislations will be analyzed in the light of the standards developed by the Inter-American Court of Human Rights throughout its jurisprudence on equality and non-discrimination (binding for both States as a party to the American Convention on Human Rights and for having accepted the competence of the Inter-American Court) with the intention of observing whether the States of Colombia and Argentina are respectful (or not) of the principle of equality and, therefore, satisfactorily surpass conventionality control in the matter.
