¿Los jueces de la “Nueva Argentina”?: formación y función de los jueces laborales bonaerenses, 1920-1955

Abstract

El artículo aborda la fi gura de los jueces de los Tribunales del Trabajo de la ciudad de La Plata en cuanto a su formación académica y en su función judicial. Se intenta de esta forma dar cuenta de la conformación de un particular funcionariado estatal cuyo rol estaba ligado al logro de algunos objetivos centrales del peronismo, como la justicia social, y que requirió escapar de la fría letra de la ley. Al tratarse de funcionarios judiciales, esta prerrogativa entró en tensión con la necesidad profesional de basar sus decisiones en leyes y jurisprudencia. Mediante el análisis de cuestiones referidas a su formación académica, los discursos gubernamentales en torno a su función social y algunos de sus fallos, se intentará problematizar la relación entre proyectos de corte académico/jurídico y las necesidades político/ estatales.

This article is an approach to the fi gures of the judges of the labor courts in the city of La Plata in terms of their academic formation and judicial role. The article will aim to examine the formation of a particular state bureaucracy whose function was linked to the achievement of some central objectives of Peronism, such as social justice, and that required to escape to the cold letter of the law. Since they were judicial civil servants, this prerogative got into tension with their professional need to base their judgments on laws and jurisprudence. Thorough the analysis of these judges’ academic background, some governmental discourses concerning their social function and some of theirs judgments, I will try to problematize the relation between academic/legal projects and political/state necessities.
