Argentina: tres reformas institucionales del kirchnerismo

Abstract

Este trabajo aborda tres reformas institucionales llevadas a cabo durante la primera gestión del presidente Néstor Kirchner. En 2006, el Congreso de la Nación, con mayoría del partido gobernante, aprobó la ley de reforma del Consejo de la Magistratura, la reglamentación de los decretos de necesidad y urgencia y la llamada ley de «superpoderes». Si bien las reformas significaron más instrumentos de gobierno en manos del presidente, también implicaron un aumento del desequilibrio entre los poderes del Estado y una democracia menos republicana. El estudio analiza cómo estas reformas incrementaron las facultades del presidente dando un paso más hacia un sistema presidencial de tipo cuasi hegemónico.

This paper deals with three institutional reforms carried out during the first administration of President Nestor Kirchner. In 2006, the National Congress, with the majority of the ruling party, approved the bill to reform the Council of the Judiciary, the regulation of Necessity and Urgency Decrees and the law called «superpowers». While these reforms meant more government instruments in the hands of the president, they also implied a widening gap between the branches of government and a less republican Democracy. The study analyzes how these reforms increased the powers of the president taking a step closer to a quasi-hegemonic type of presidential system.
