Resumen

This article discusses the current legal aspects related to the protection of nuclear facilities under international law, especially regarding belligerent occupation.A comprehensive analysis of all relevant international instruments allows us to overcome the de facto / de jure dichotomy regarding state responsibility for nuclear safety and nuclear security in cases of foreign interim control of nuclear facilities.
