La Hidrovía Paraguay-Paraná como corpus iuris aquarum

Abstract

El interés concitado por la licitación y posterior concesión de la vía fluvial Paraná, Río de la Plata, Magdalena, genera un espacio óptimo para referirnos a la hidrovía ParaguayParaná desde la perspectiva jurídica y, más enfáticamente, desde la triple óptica del Derecho Internacional Público, del Derecho de Aguas y del Derecho Ambiental. Esas tres ramas de la enciclopedia jurídica forman el marco teórico sobre el que descansa el presente trabajo. La perspectiva internacional se justifica porque la hidrovía ParaguayParaná es parte de una cuenca transfronteriza entre cinco países que, a su vez, integran el Mercosur (con Bolivia en proceso de adhesión plena). El abordaje ambiental no puede estar ausente por cuanto se trata de uno de los derechos y garantías consagrados por la Constitución Nacional de cada uno de los ribereños. El objetivo específico de esta investigación es indagar sobre el grado de coherencia y robustez de ese conjunto normativo y, en razón de ello, colegir que componen un corpus iuris aquarum aplicable a la hidrovía Paraguay-Paraná.

The interest aroused by the public tender and subsequent concession of the Paraná – Río de la Plata and Magdalena waterway, gives us the opportunity to talk about the Paraguay-Paraná rivers from the legal point of view and, more emphatically, from the triple perspective of Public International Law, Water Law and Environmental Law. These three branches of the legal encyclopaedia will be the theoretical framework on which this paper is based. The international perspective is justified because the Paraguay-Paraná waterway is part of a transboundary basin among five countries that, in turn, are members of the Mercosur (for which Bolivia is in process of full membership). The environmental approach is a key factor since it is one of the rights and guarantees enshrined in each riparian’s National Constitution. The specific objective of this research is to scrutinize the degree of coherence and robustness of this array of regulations and, therefore, to deduce the extent to which they are a corpus iuris aquarum applicable to the Paraguay-Paraná waterway.
