¿Será Justicia? Cuota santafesina e interpretaciones jurídicas

Abstract

La provincia de Santa Fe, Argentina, cuenta con ley de cupo desde el año 1992. Esta medida busca equiparar las posibilidades de participación política de mujeres y varones, estableciendo un mínimo de presencia femenina en las listas. Dado que la misma ha generado vacíos legales ante su aplicación, se requirió de la mirada y la respuesta judicial para resolver determinados conflictos. En el presente trabajo se expondrán dichos conflictos y se analizarán las diferentes respuestas dadas por la Justicia Argentina ante estas situaciones. ¿Responde de la misma manera? ¿Se generan distintas respuestas en función de las presiones recibidas? ¿Se subordina a la mujer y a su participación política a partir de dichos fallos? ¿Hay una mirada con perspectiva de género ante la situación de la mujer en política? Estas son algunas de las preguntas que surgen al observar la situación santafesina y que nos permitirán retrabajar la noción de género y política y pensar nuevos mecanismos para igualar política y judicialmente a la mujer y al varón. Para ello se propone utilizar el enfoque teórico de la crítica feminista al derecho para analizar el caso de la ley de cupo en la Provincia de Santa Fe.

The province of Santa Fe has had a quota law since 1992. This measure sought to equalize the possibilities of political participation of women and men, establishing a minimum of female presence in the lists.Since it has generated legal gaps in its application, it required the judicial regardand response to resolve certain conflicts. In the present work, these conflicts will be exposed and the different answers given by the Argentine Justice before these situations will be analyzed. Does it respond in the same way? Are there different responses depending on the pressures received? Are women and their political participation subordinated based on such failures? Is there a gender perspective regarding the situation of women in politics? These are some of the questions that arise when observing the Santa Fe situation and that will allow us to rework the notion of gender and politics and think about new mechanisms to equal politically and judicially women and men. To do this, it is proposed to use the theoretical approach of feminist criticism of law to analyze the case of the quota law in Santa Fe.
