La construcción cotidiana de legitimidad: atentados contra jueces y abusos de autoridad en una jurisdicción periférica de la Monarquía española. Mendoza, 1770-1810

Abstract

Este trabajo aborda la construcción de legitimidad en la experiencia cotidiana de la justicia. Se analizan expedientes judiciales motivados por conductas y discursos que atacaron el orden político a través de su resistencia a los jueces locales y causas en las que éstos fueron los imputados por abuso de autoridad. El objetivo es detectar las motivaciones de los sujetos que pasaron la línea de los actos aceptados o tolerados, el modo en que las autoridades interpretaron sus conductas y los procedimientos judiciales e infrajudiciales que iniciaron para castigar a los culpables y evitar la repetición de conductas subversivas.

This paper addresses the legitimacy built through the daily experience of justice. It analyzes judicial files motivated by behaviors and speeches that had attacked the political order through their resistance to local judges. It also includes causes in which the judges themselves were imputed due to abuse of authority. The aim is to identify the motivations of subjects that exceeded the bounds of accepted or tolerated acts at the local order, but also the way in which the authorities interpreted their behavior, the judicial and infrajudicial procedures initiated to punish the offenders and maintain the social control in the long-­‐‑term, prevent the repetition of subversive behaviors.
