Representaciones al interior del Poder Judicial: imaginarios acerca del migrante externo respecto de la identidad nacional y la ciudadanía

Abstract

Este artículo aborda las representaciones sociales contemporáneas que miembros del Poder Judicial del Área Metropolitana de Buenos Aires (AMBA) construyen sobre migrantes europeos que han arribado al país y migrantes sudamericanos recientes, teniendo en cuenta dos dimensiones: la identidad nacional y la ciudadanía. La premisa de la cual se parte, entiende que las relaciones interculturales poseen un carácter asimétrico conformando un polo dominante (nativos) y un polo dominado (migrantes). Por eso mismo, interesa comprender qué mecanismos posibilitan la configuración de relaciones interculturales como relaciones de dominación tomando como referencia la institución judicial encargada de sancionar ilegalismos y mediante la cual el Estado gestiona la diversidad cultural. Se parte de la hipótesis de que las relaciones interculturales se encuentran legitimadas de acuerdo a un código moral hegemónico, que establece criterios de normalidad-desviación siendo funcional al polo dominante.

The paper approaches the social contemporary representations that judicial system´s members from the Metropolitan Area of Buenos Aires (AMBA) build about European migrants and South American migrants, taking into account two dimensions: national identity and citizenship. Considering the premise that intercultural relations have an asymmetrical character, it can generally be said that a dominant pole (native) and a dominated pole (migrants) are shaped. For this reason, the aim is to understand which mechanisms enable the configuration of intercultural relations as relations of domination, assuming that the judicial institution is responsible for punishing illegalities and through which the state manages cultural diversity. The paper also works on the hypothesis that intercultural relations are legitimized by an hegemonic moral code that establishes criteria of normality-deviation and end up being functional to the dominant pole.
