Estado de situación y análisis jurídico de la regulación de los incendios forestales en Argentina y Uruguay

Abstract

Los primeros meses del año 2015 fueron testigos de graves episodios de incendios forestales en el sur de Argentina (en particular en las Provincias de Chubut y Neuquén). Debido a la relevancia de esta temática, el objetivo del presente trabajo es realizar un análisis comparativo entre la normativa vigente sobre manejo de los incendios forestales en Argentina y en Uruguay, a n de poder detectar fortalezas y debilidades. En primer lugar y en el caso de Argentina, nos abocaremos a ahondar en el texto de la Ley de Manejo del Fuego, n° 26.815, que fue promulgada en enero de 2013, lo cual implicará forzarnos a realizar un análisis incipiente y necesario, debido a la inexistencia de casos jurisprudenciales hasta el momento, y de escasos artículos doctrinarios sobre esta materia. También nos referiremos a la importancia del análisis social, económico y ambiental de los bosques y de sus servicios ecosistémicos. En segundo lugar, la situación jurídica de Uruguay es diferente al caso anterior, ya que no se ha dictado una norma jurídica especí ca que regule sobre el manejo y la prevención de los incendios forestales, sino que sus lineamientos generales son regulados principalmente en la Ley Forestal, n° 15.939, de 1988. Sin embargo, se ha tratado la temática parcialmente a través del Decreto n° 849/88 (reformado mínimamente por el Decreto n° 188/02), y el Decreto n° 111/89 sobre prevención y combate de incendios forestales, en donde se estableció que, además, deberá cumplirse con los reglamentos de policía del fuego dictados por el Poder Ejecutivo Nacional.

At the beginning of 2015 huge forests res took place at the south of Argentina (especially in the provinces of Chubut and Neuquén). Due to the importance of this fact, the purpose of this paper is to make a comparative analysis of the present regulations about forests res management in Argentina and in Uruguay, in order to state strengths and weaknesses. In the rst place and in the case of Argentina, we will analyse the text of the Enviromental Protection National Act n° 26.815, 2013, and which will make us focus on a recent and necessary study due to the inexistence of case law up to now, and also of a few existing scienti c papers which study this subject. Also we will analyze the importance of social, economic and environmental impacts on forests and on their ecosystem services. In the second place, the legal situation of Uruguay is different to the previous case because there isn´t an speci c act which regulates management and prevention of re forests, because its main guidelines are mentioned at Forest Act n° 15.939, 1988. Notwithstanding, the present issue was partially regulated through the enactment of Decree n° 849/88 (which was slightly modi ed by Decree n° 188/02), and by Decree n° 111/89 about prevention and ghting of forests res, where it is stated that also re police regulations enacted by the National Executive power must be ful lled.
